Bryce Davis appealed the denial of his Rule 24.035 motion for post-conviction relief, alleging ineffective assistance of counsel. He claimed his plea counsel failed to timely file a motion to change venue, which he believed rendered his guilty plea involuntary. The appellate court affirmed the motion court's denial, finding that Movant was aware of the untimeliness of the venue motion prior to his plea. Therefore, his attestations of satisfaction with counsel during the plea hearing were either genuine or a knowing misrepresentation, and the motion court did not clearly err in concluding his plea was voluntary.
