City of De Soto and James Acres, Appellants, vs. Michael L. Parson, Governor of the State of Missouri, et al., Respondents.
The City of De Soto and James Acres sued the Governor and Attorney General, seeking a declaratory judgment that section 321.320 was an unconstitutional special law and House Bill No. 1446 (HB 1446) violated the single-subject provision of the Missouri Constitution. The circuit court granted summary judgment for the state. The Missouri Supreme Court vacated the circuit court's judgment, holding that HB 1446 violated the single-subject rule and that judicial severance was not applicable, thus invalidating the entire bill. The case was remanded for the circuit court to enter judgment for the Plaintiffs.
