Officials from St. Louis County political subdivisions sued the State of Missouri, seeking a declaratory judgment that section 115.646, RSMo, which prohibits using public funds for political advocacy, violates the First and Fourteenth Amendments. The circuit court granted summary judgment for the officials, declaring the statute unconstitutional. The Missouri Supreme Court vacated the circuit court's judgment and remanded the case, holding that the statute regulates the use of public funds, not speech, and its terms are not unconstitutionally vague.
