Clarkson Construction Co. vs. Alisa Warren, Missouri Commission on Human Rights, and Charles Watkins
Clarkson Construction Company appealed the denial of its petition for a writ of mandamus, seeking to compel the Missouri Commission on Human Rights (MCHR) to withdraw a second right-to-sue notice issued to a former employee, Charles Watkins. Clarkson argued that MCHR exceeded its statutory authority by accepting a second discrimination charge that related to an earlier charge, in violation of section 213.111.1. The appellate court affirmed the circuit court's judgment, holding that the two charges alleged separate and distinct discriminatory practices or acts, and thus MCHR acted within its statutory authority.
