Clayton D. Reehten appealed the denial of his Rule 29.15 motion for post-conviction relief following an evidentiary hearing. The motion court had granted an extension to file an amended motion after the initial deadline had passed. The appellate court determined that the motion court lacked authority to grant an extension after the filing deadline had expired without first conducting an abandonment inquiry. Therefore, the judgment denying post-conviction relief was reversed, and the case was remanded for the motion court to conduct an abandonment inquiry.
