Clint Arrington was convicted of six offenses, including felonious restraint. On appeal, he challenged only the felonious restraint conviction, arguing the trial court plainly erred by not sua sponte instructing the jury on the lesser-included offense of false imprisonment. The appellate court disagreed, affirming the judgment based on Supreme Court precedent holding that a trial court is not obligated to sua sponte instruct on lesser-included offenses when not requested by the defense.
