State of Missouri vs. Cole G. Fox
Cole Fox appealed his conviction for felony possession of tetrahydrocannabinol (THC). He argued that the charging document failed to state a crime because it did not allege possession of more than 35 grams of THC, and that the evidence was insufficient to support the conviction. The appellate court affirmed, holding that THC possession is not subject to the 35-gram exception for marijuana and that the State presented sufficient evidence, including proper chain of custody, to support the conviction.
