Courtney Curtis, Appellant, vs. The Missouri Democratic Party, et al., Respondents.
Representative Courtney Curtis sought a writ of mandamus to compel the Missouri Democratic Party, its chair, and the Missouri Secretary of State to accept his filing fee and declaration of candidacy for the 14th senate district. The circuit court quashed its preliminary order in mandamus. The Missouri Supreme Court affirmed, holding that the Missouri Democratic Party and its chair are not public officials subject to mandamus, and the Secretary of State could not be compelled because Curtis never tendered his filing fee to that office.
