Daniel Fields vs. State of Missouri
Daniel Fields pleaded guilty to two counts of first-degree statutory sodomy and was sentenced to consecutive fourteen-year terms. He filed a Rule 24.035 motion, claiming ineffective assistance of counsel because his plea counsel failed to advise him of the possibility of civil lifetime commitment as a sexually violent predator. The motion court denied his claim, finding his testimony not credible. The appellate court affirmed, holding that civil commitment as an SVP is a collateral consequence, and counsel is not ineffective for failing to advise on such consequences.
