Missouri Court of Appeals, Eastern District / Oct 1, 2019
Danny Harris, Appellant, vs. Ralls County, Missouri, Respondent.
Danny Harris appealed the Labor and Industrial Relations Commission's decision modifying an Administrative Law Judge's award for his work-related back injury. The Commission found Harris was not permanently totally disabled and suffered only five percent permanent partial disability, denying future medical benefits. The appellate court affirmed the Commission's findings that Harris was not permanently totally disabled and not entitled to future medical treatment. However, the court reversed and modified the Commission's determination of medical causation and the permanent partial disability rating, increasing it from five percent to twenty percent, finding it was against the overwhelming weight of the evidence and that the Commission erred in disregarding precedent.
