Supreme Court of Missouri / Jun 13, 2023
David Prior Wilmoth, Appellant, vs. Director of Revenue, Respondent.
David Wilmoth appealed the circuit court's judgment affirming the Director of Revenue's suspension of his driver's license for an alcohol-related traffic offense. Wilmoth challenged the admission of preliminary breath test (PBT) results and the sufficiency of evidence for probable cause. The Missouri Supreme Court affirmed, holding that the numerical result of a PBT is admissible as evidence of probable cause to arrest and that the circuit court's finding of probable cause was supported by substantial evidence and not against the weight of the evidence.
