David R. Hosier appealed the denial of his Rule 29.15 motion for postconviction relief, following his convictions for first-degree murder and other charges, for which he received a death sentence. Hosier claimed ineffective assistance of trial and appellate counsel on multiple grounds, including failure to stipulate to a prior felony, failure to sever charges, failure to call a medical expert, failure to strike jurors, and failure to object to certain testimony and arguments. He also challenged the motion court judge's failure to recuse. The Missouri Supreme Court affirmed the motion court's judgment, finding no clear error in its findings or abuse of discretion in its rulings, and concluding that Hosier failed to demonstrate ineffective assistance or prejudice.
