Gregory Leyh, an expert witness, appealed a judgment enforcing a settlement and imposing a $35,000 sanction against him in a contempt proceeding. The contempt arose from Leyh's disclosure of a confidential deposition in separate litigation, allegedly violating a protective order. The appellate court affirmed the trial court's finding that the parties reached an enforceable settlement agreement on July 26, 2018. However, the court reversed the remainder of the judgment, including the sanction, finding that Leyh did not act in bad faith or engage in unethical conduct, and that subsequent negotiations did not modify the original agreement.
