Missouri Court of Appeals, Southern District / Mar 5, 2021
STATE OF MISSOURI, Plaintiff-Respondent vs. DEMARCUS OWENS, Defendant-Appellant
Demarcus Owens was found guilty of multiple charges and appealed the trial court's denial of his second motion for a competency evaluation. The trial court had previously ordered an evaluation which concluded Owens was malingering and competent. The appellate court affirmed the denial, finding no error in the trial court's reliance on the prior evaluation, testimony from the jail administrator, and its own observations, which collectively provided substantial evidence to support the competency determination.
