Deonta Johnson appealed the motion court's judgment overruling his Rule 24.035 post-conviction relief motion without an evidentiary hearing. Johnson claimed his plea counsel was ineffective and the circuit court erred by misrepresenting a life sentence as being "calculated at 30 years," leading him to believe he would serve a maximum of 30 years. The appellate court reversed the motion court's judgment, holding that the record did not conclusively refute Johnson's claims of prejudice, thus entitling him to an evidentiary hearing. The case was remanded for further proceedings.
