Destynie Wright vs. State of Missouri
Destynie Wright appealed the denial of her Rule 29.15 motion for post-conviction relief after being convicted of involuntary manslaughter, assault, and armed criminal action. The motion court had granted a second extension for filing Wright's amended motion, which the State argued was untimely. The appellate court reversed the denial and remanded the case, holding that the motion court exceeded its authority under the applicable version of Rule 29.15(g) by granting a second extension, thereby rendering the amended motion untimely. The case was remanded for the motion court to conduct an abandonment inquiry.
