Missouri Court of Appeals, Eastern District / Jul 18, 2023
State of Missouri, Respondent, v. Dexter Wiggley, Appellant.
Dexter Wiggley was convicted of first-degree murder and armed criminal action and sentenced to life in prison. On appeal, Wiggley argued the trial court erred by admitting a photograph with a police officer's handwritten notation, contending it was inadmissible hearsay. The appellate court affirmed the judgment, holding that the notation constituted Wiggley's adoptive admission and was therefore not hearsay. The court also declined to review his unpreserved claim of improper bolstering for plain error.
