Dorian J. Perry, an inmate, was convicted of committing violence against a fellow inmate. On appeal, Perry argued that the trial court erred by refusing to submit his proffered jury instruction on the affirmative defense of duress. The appellate court affirmed the conviction, concluding that the duress instruction was not supported by the evidence because the alleged threat was not present, imminent, and impending, and Perry had an opportunity to avoid the act.
