Missouri Court of Appeals, Western District / Dec 18, 2018
Dorothy Smith vs. Capital Region Medical Center, et al
Dorothy Smith appealed the dismissal of her petition seeking to hold Capital Region Medical Center in civil contempt for failing to pay interest on a workers' compensation award. The trial court dismissed the petition, concluding that civil contempt does not lie to compel the payment of a money judgment. The appellate court affirmed, holding that while the trial court had jurisdiction to calculate the interest, civil contempt is not a permissible means to enforce a mere money judgment under Missouri law.
