Kristal Fulton sued Drive Rite, LLC, alleging violations of the Missouri Merchandising Practices Act and fraudulent misrepresentation related to a car purchase where she did not receive a certificate of title. The trial court granted partial summary judgment for Drive Rite, finding no violation of section 301.210.4 RSMo because the sale was not complete. Fulton appealed this partial summary judgment after dismissing her remaining claims. The appellate court dismissed the appeal for lack of jurisdiction, holding that a partial summary judgment on an issue, rather than a full claim, is not a final, appealable judgment.
