Dustin Curtis Winter appealed his convictions for first-degree murder and first-degree kidnapping, along with a clerical error in his sentencing judgment. The appellate court affirmed the murder conviction, finding sufficient evidence of Victim's death, Winter's perpetration, and deliberation. However, the court reversed the kidnapping conviction, concluding there was insufficient evidence that the confinement was for a substantial period or more than merely incidental to the murder.
