D.W., who was found not guilty by reason of mental disease or defect for two counts of murder and two counts of armed criminal action in 1995, appealed the trial court's denial of her application for unconditional release from the Missouri Department of Mental Health. The trial court denied the application, finding D.W. failed to prove by clear and convincing evidence that she would not be a danger to herself or others in the foreseeable future, particularly if she ceased taking her medication. The appellate court affirmed the trial court's judgment, concluding that the denial was supported by substantial evidence and was not against the weight of the evidence.
