D.Z.G. appealed the trial court's dismissal of his petition to expunge a conviction for resisting arrest by fleeing. The Missouri State Highway Patrol argued that "death" is an element of the offense, making it ineligible for expungement under section 610.140. The appellate court reversed the dismissal, holding that "death" is not an element of the class E felony of resisting arrest under section 575.150, and remanded the case for further proceedings.
