Lake Forest Development Corporation appealed a judgment declaring that its lessee, EHCC Clayton Corporation, had exercised its option to renew a commercial lease for a 10-year term. The trial court found that EHCC's actions of holding over and continuing to pay rent after the previous term ended constituted a renewal as a matter of law. The trial court also found that Lake Forest, by accepting these rent payments, waived its right to receive formal written notice of renewal. The appellate court affirmed the trial court's judgment, agreeing that the lease was renewed by the parties' conduct.
