State of Missouri vs. Eric V. McMillon
Eric V. McMillon was convicted by a jury of statutory rape and statutory sodomy. On appeal, McMillon contended that the circuit court erred by changing the venue of his trial from western Jackson County to eastern Jackson County, arguing a lack of statutory authority for such a transfer and a violation of his constitutional rights. The appellate court affirmed the judgment, holding that the presiding judge had the administrative authority to order the trial to be held at the Eastern Jackson County Courthouse, as it was a change of facility, not a statutory transfer of venue, and was supported by constitutional and statutory provisions.
