Missouri Court of Appeals, Southern District / Jul 2, 2018
BEN BROWER PROPERTY CO., LLC, Plaintiff-Respondent, v. EVELLA, LLC, Defendant-Appellant.
Ben Brower Property Co., LLC (Brower) sued Evella, LLC (Evella) to quiet title to a disputed strip of land between their properties, claiming adverse possession. Following a bench trial, the trial court quieted title in Brower. Evella appealed, arguing the trial court erred by requiring it to plead and prove the public status of a road on the property, denying its motion to amend pleadings, and excluding evidence. The appellate court affirmed the trial court's judgment, finding no error in the trial court's rulings on the pleading requirements, the denial of leave to amend, or the exclusion of evidence.
