Respondent

The Yusts and Investors Title Company appealed the trial court's orders granting a new trial on its own motion and subsequently granting judgment notwithstanding the verdict (JNOV) for FasterHouse LLC and Rebecca Moran. The appellate court reversed the JNOV, finding the trial court lacked jurisdiction after the notice of appeal was filed. It also reversed the new trial order because the trial court failed to specify the grounds for granting it, as required by Rule 78.03, and the presumption of error under Rule 84.05(c) was unrebutted. The case was remanded for further proceedings, and the Yusts were awarded attorney's fees on appeal.
