Missouri Court of Appeals, Western District / May 11, 2021
F.J.M., Individually and as Next Friend for A.E.J.J. vs. F.L.J.
Mother appealed the trial court's judgment declaring Father as the natural father of Child, awarding Father sole legal custody, and establishing joint physical custody and no child support. Mother argued the trial court lacked jurisdiction to modify a prior administrative child support order and erred by not dismissing Father as a party despite DNA evidence of non-paternity, given an existing Acknowledgment of Paternity. The appellate court affirmed, holding that the administrative order was not a final judgment conferring exclusive jurisdiction, and the unchallenged Acknowledgment of Paternity legally established Father's paternity, precluding further challenges by the signatories.
