Nancy J. Ducoulombier vs. Ford Motor Company
Nancy J. Ducoulombier sued Ford Motor Company for negligence and wrongful death, alleging Ford failed to provide proper medical attention to her husband after he became incapacitated at work, leading to his death. The circuit court granted summary judgment for Ford, concluding that the Division of Workers' Compensation had exclusive statutory authority over the claim. The appellate court affirmed, holding that because the claims involved an employer/employee relationship, the Commission had the exclusive authority to determine if the injury arose out of and in the course of employment, thus precluding a civil action.
