Deborah Lehmann vs. Fox C-6 School District
Deborah Lehmann, a teacher, sought a declaratory judgment and injunctive relief against the Fox C-6 School District, arguing that two District policies used as a basis for her termination proceedings were invalid because they did not strictly comply with statutory promulgation requirements. The trial court agreed, finding the policies void. The appellate court reversed, holding that school districts are only required to substantially comply with § 171.011, RSMo, for policy promulgation, as it is a directory statute, and that the District had substantially complied.
