State of Missouri vs. Francis Henry Kempker
Francis Henry Kempker appealed his convictions for possession of methamphetamine and lorazepam following a bench trial. He challenged the sufficiency of the evidence for both convictions. The appellate court affirmed the conviction for methamphetamine possession, finding sufficient evidence based on a lab report and an evidence bag label. However, the court reversed the conviction for lorazepam possession, concluding that the State failed to present sufficient additional incriminating circumstances to prove constructive possession.
