Supreme Court of Missouri / Mar 15, 2022
State of Missouri, Appellant, vs. Gary Andrews, Jr., Respondent.
Gary Andrews, Jr. was charged with multiple offenses, including possession of a controlled substance and unlawful use of a weapon. After pleading guilty to the weapon charge, the circuit court dismissed the possession count on double jeopardy grounds. The Missouri Supreme Court reversed, holding that the Double Jeopardy Clause prohibits multiple punishments for the same offense but does not prohibit the State from prosecuting multiple offenses in a single proceeding. The case was remanded for further proceedings on the possession count.
