Missouri Court of Appeals, Southern District / Jul 9, 2018
GENE E. HAYNES, Appellant, vs. STATE OF MISSOURI, Respondent.
Gene Haynes filed a pro se motion for postconviction relief after pleading guilty to multiple crimes, alleging his sentences were not being treated concurrently by the Department of Corrections. The motion court granted his motion by issuing a corrected judgment but then dismissed the case without appointing counsel. The appellate court reversed the dismissal and remanded the case, holding that the appointment of counsel is mandatory for indigent pro se movants in postconviction relief proceedings under Rule 24.035.
