Missouri Court of Appeals, Eastern District / Jun 7, 2022
George Chavis, Appellant, v. Wal-Mart Associates, Inc., and Division of Employment Security, Respondents.
George Chavis appealed the Labor and Industrial Relations Commission's decision denying him unemployment compensation, which concluded he voluntarily left his employment. The appellate court reversed, finding the Commission's conclusion that Chavis voluntarily left work was unsupported by sufficient competent evidence. The court held that Chavis's absence due to a non-work-related illness, coupled with his attempts to contact his employer, did not constitute a voluntary quit. The case was remanded to the Commission to grant Chavis appropriate unemployment compensation.
