Gerardo Gonzalez, Sr. was convicted by a jury of two counts of statutory sodomy and sentenced to 30 years in prison. On appeal, Gonzalez requested plain error review, arguing the trial court erred in admitting testimony of uncharged acts without pretrial notice or determination of admissibility, and that the evidence was improper propensity evidence. The appellate court declined plain error review, finding that defense counsel strategically allowed the admission of the uncharged conduct, and affirmed the trial court's judgment.
