Missouri Court of Appeals, Western District / Aug 27, 2019
Hal Miller vs. Securitas Security Services USA, Inc., et al
Hal Miller sued his former employer, Securitas Security Services USA, Inc., alleging disability discrimination, religious discrimination, and retaliation under the Missouri Human Rights Act. The trial court granted Securitas's motion to dismiss Miller's claims and compel arbitration, dismissing the petition with prejudice and taxing costs against Miller. The appellate court affirmed the trial court's finding of a valid arbitration agreement, but reversed the dismissal with prejudice, holding that the proper remedy was to stay the proceedings pending arbitration, and vacated the award of court costs as premature.
