Missouri Court of Appeals, Southern District / Nov 4, 2019
TODD BUSQUE, Plaintiff-Respondent v. HALSTON HECK, Defendant-Appellant
Todd Busque, a mechanic, obtained a judgment against Halston Heck, a truck owner, for repairs. Heck appealed, arguing the trial court erred in denying his Magnuson-Moss Warranty Act counterclaim and enforcing the oral contract for repairs due to the statute of frauds. The appellate court affirmed the trial court's judgment, finding that the rear-end issues were unrelated to the transmission repairs and that the oral contract was primarily for services, not the sale of goods, thus not subject to the UCC's statute of frauds.
