Alpha Petroleum Company vs. Hani Daifallah, et al
Alpha Petroleum Company sued Hani and Mohammed Daifallah for nonpayment of fuel invoices supplied to a convenience store they operated. The trial court found the Daifallahs personally liable for the debt on a claim of nonpayment on account, but denied Alpha Petroleum's alternative claim for unjust enrichment. On appeal, the Daifallahs challenged their personal liability, arguing a corporation was responsible. The appellate court affirmed, holding that substantial evidence supported the trial court's finding that the Daifallahs were personally liable due to their failure to disclose an agency relationship. Alpha Petroleum's cross-appeal was denied as moot.
