Diana J. Thompson, et al. vs. Heirs of Kathryn L. Metcalf, et al.
Diana Thompson, the successful bidder at a tax sale, sought to quiet title to real property, but the trial court granted summary judgment to the original owner's siblings, Jerry and Joanne Metcalf, voiding Thompson's collector's deed. The trial court found Thompson failed to notify Joseph Metcalf, the owner by beneficiary deed, of his right to redeem the property. On appeal, the Western District affirmed, holding that Joseph's beneficiary designation constituted a "publicly recorded claim" entitling him to redemption notice, which Thompson failed to provide. The court also concluded that Jerry and Joanne had standing to challenge the deed and that Thompson's claim for reimbursement for improvements was not properly supported in the summary judgment record.
