D.C.M., a minor, appealed a circuit court judgment finding he committed an act that would constitute a felony (making a terrorist threat) if committed by an adult. He challenged the sufficiency of the evidence, the denial of a continuance, and claimed ineffective assistance of counsel. The Missouri Supreme Court affirmed the circuit court's denial of the continuance and its finding of sufficient evidence. However, the Court found the record insufficient to determine the ineffective assistance of counsel claim on direct appeal and remanded the case for an evidentiary hearing on that issue.
