In the Matter of the Care and Treatment of Wade Turpin vs. State of Missouri
Wade Turpin, involuntarily committed as a sexually violent predator, petitioned for conditional release. The trial court denied his petition, finding he failed to prove he no longer suffered from a mental abnormality making him likely to engage in sexual violence if released. On appeal, Turpin argued the trial court erred by not considering the conditions of release set out in § 632.505, as required by In re Care and Treatment of King. The appellate court affirmed, holding that Turpin failed to preserve his argument regarding specific findings and that the record showed the trial court did consider the statutory conditions.
