Missouri Court of Appeals, Western District / Dec 27, 2022
Arlene Wickham vs. Jean Hummel
Arlene Wickham sued nurse Jean Hummel for medical malpractice after a knee replacement surgery led to a below-the-knee amputation. A jury found Hummel 100% at fault for failing to perform proper neurovascular assessments and notify the surgeon of Wickham's deteriorating condition. Hummel appealed the judgment and the denial of her motion for judgment notwithstanding the verdict. The appellate court affirmed the trial court's judgment, finding Wickham presented a submissible case on both breach of the standard of care and causation, and that the trial court did not err in its handling of damages.
