Jefferson Capital Systems, LLC (JCAP) appealed the circuit court's denial of its amended motion to compel arbitration of Stephanie Rice's Fair Debt Collection Practices Act counterclaim. JCAP argued it had standing to enforce an arbitration agreement through a series of assignments from the original debt holder, DriveTime. The appellate court affirmed the circuit court's decision, finding that JCAP failed to provide competent evidence to establish a valid chain of assignment of arbitration rights.
