Jeffrey A. Waters was convicted of statutory sodomy and attempted statutory sodomy, but the jury could not reach a verdict on statutory rape and incest charges, leading to a mistrial on those counts. The circuit court entered a judgment on the convictions but remained silent on the mistried counts, which remained pending. The Supreme Court of Missouri dismissed Waters's appeal, holding that a criminal judgment is not final for purposes of appeal under section 547.070 if any count in the indictment or information remains pending before the circuit court.
