Jeffrey Waters was found guilty by a jury on two counts of statutory sodomy and attempted statutory sodomy, but a mistrial was declared on two other counts of statutory rape and incest, which remained pending. The trial court entered a judgment reflecting the convictions and sentences on the two guilty counts. The Southern District of the Missouri Court of Appeals dismissed Waters' appeal, holding that a judgment is not final for appellate review in a multi-count criminal case until all counts have been resolved.
