Jeffrey Laurence Treta vs. State of Missouri
Jeffrey L. Treta appealed the denial of his Rule 24.035 motion for post-conviction relief, arguing his convictions and sentences for two counts each of statutory rape and forcible rape for two single acts were duplicative and violated his constitutional right against double jeopardy. The motion court denied his motion after an evidentiary hearing. The appellate court affirmed, holding that the legislature intended forcible rape and statutory rape to be separate and distinct crimes with separate punishments, thus not violating double jeopardy.
