Jeremy Wayne Floyd appealed his convictions for possession of a controlled substance and tampering with physical evidence. He argued the trial court abused its discretion by excluding hearsay testimony from a witness who claimed another person admitted the drugs belonged to him. The appellate court affirmed, finding the testimony inadmissible because ownership is not an element of possession, and the State's cross-examination did not "open the door" for the rebuttal evidence.
