John C. Duvall vs. Missouri Board of Probation and Parole, Et al.
John C. Duvall appealed the trial court's dismissal of his amended petition for declaratory judgment against the Missouri Board of Probation and Parole. Duvall's petition challenged his underlying convictions, alleging fraud in his Rule 29.15 post-conviction proceedings, and also claimed that the denial of parole and participation in the Missouri Sex Offender Program (MOSOP) violated his religious freedom. The appellate court affirmed the dismissal, holding that the claims were barred by res judicata or failed to state a cognizable cause of action due to a lack of a legally protectable interest in parole.
