Missouri Court of Appeals, Eastern District / Sep 15, 2020
John H. Bonds, Appellant, vs. State of Missouri, Respondent.
John H. Bonds appealed the dismissal of his pro se Rule 24.035 motion for post-conviction relief, which the motion court had found untimely. The motion court dismissed the motion without appointing counsel for Bonds, an indigent movant. The appellate court reversed the judgment, holding that the motion court clearly erred by failing to appoint counsel as required by Rule 24.035(e), even if the motion appeared untimely. The case was remanded for the appointment of counsel and further proceedings.
