JOHN R. THOMAS, Appellant vs. STATE OF MISSOURI, Respondent
John R. Thomas appealed the denial of his Rule 24.035 motion, which challenged the rescission of a § 559.115 callback option. Thomas had been granted a furlough with conditions after a plea agreement, but he violated those conditions by using controlled substances and failing to surrender himself. The appellate court affirmed the motion court's judgment, finding that the plea court did not exceed its authority, violate Thomas's right to withdraw his plea, or err by not appointing counsel before rescinding the callback option, as Thomas had voluntarily agreed to the consequences of violating the furlough conditions.
